Abstract

The legal capacity of minors to grant a will is one of the institutions that are included in the Cuban civil order because of the promulgation of the new Family Code; however, it is not something new since it has its origins from Roman law. The reduction of the age to carry out this legal act (12 years) constitutes a controversial issue, which is why the present investigation addresses the historical evolution of this figure to the present for its better understanding. The legal, historical and theoretical foundations that support the Law of succession in the world and in Cuba are addressed, making an analysis of the importance of the will as a legal act where the person establishes how their assets will remain after death and the trend in today's world of granting that right to minors, based on one of the principles collected.
