Abstract
In a context of growing international mobility, conflicts arising from noncompliance with Food judgments handed down in one country, but which require enforcement in another, are increasingly frequent. Cuba is not exempt from this, the absence of effective legal mechanisms limits the protection of Food rights, especially when the person obliged resides outside the national 8 territory. This research focuses on analyzing the normative inadequacies of Cuban procedural legislation for the international execution of maintenance sentences according to the effective exercise of effective jurisdictional protection. The research is based on theoretical methods, such as historical-logic analysis synthesis, inductive-deductive and comparative law, as well as empirical tools, including case studies, documentary review and interviews with specialists. This seeks to provide a critical view of the procedural challenges facing Cuba in this matter, concluding that the integration of adequate mechanisms for the international execution of Food judgments, the creation of central authority, the adherence to global agreements and the implementation of specific procedures and coercive measures represent fundamental steps to guarantee the effectiveness, equity and speed in the execution of these judgments.
