Cuba no reconoce legalmente el Síndrome de Alienación Parental, síndrome que aparece como consecuencia de un divorcio altamente conflictivo donde uno de los progenitores opta por utilizar a su propio hijo para manipularlo en contra del otro. Este flagelo que hoy toca a la sociedad cubana trae consigo efectos sobre los menores de edad que pueden ser irreversibles, vulnerando sus principales derechos y atentando contra el interés superior del menor. Varias legislaciones reconocen ya su existencia y de una forma u otra establecen medidas y sanciones para contrarrestar sus efectos, considerándose un gran paso de avance. Este síndrome constituye una forma de maltrato infantil, por tanto, una vez que ha ocurrido y es diagnosticado, puede tener consecuencias legales, tanto en el Derecho de Familia como en el Derecho Penal. Por ello es preciso que se adecúen las normas cubanas, de acuerdo a la realidad social existente, para así garantizar la plena satisfacción de los derechos de los menores de edad. La presente investigación se centra fundamentalmente en ofrecer una propuesta para la regulación en el ordenamiento jurídico cubano del Síndrome de Alienación Parental: como una causa de suspensión o privación de la patria potestad y como un delito.
Cuba does not legally recognize the Parental Alienation Syndrome, a syndrome that appears as a consequence of a highly conflictive divorce where one of the parents chooses to use his own son to manipulate him against the other. This scourge that today affects Cuban society has effects on minors that can be irreversible, violating their main rights and undermining the best interests of the child. Several legislations already recognize its existence and in one way or another establish measures and sanctions to counteract its effects, considering it a great step forward. This syndrome is a form of child abuse, therefore, once it has happened and is diagnosed, it may have legal consequences, both in the field of Family Law as in Criminal Law. Therefore, it is necessary to adapt Cuban norms, according to the existing social reality, in order to guarantee the full satisfaction of the rights of minors. The present investigation focuses primarily on offering a proposal for the regulation in the Cuban legal system of the Parental Alienation Syndrome: as a cause of suspension or deprivation of parental authority and as a crime.
